DWI Standards for Truck & Commercial Drivers

Drivers who get behind the wheel while intoxicated or under the influence of drugs place others on public roads and highways in serious danger and at serious risk of suffering injuries and fatalities. When these drivers get behind the wheel of massive commercial trucks – including 18-wheelers, tractor-trailers, and other large freight bearing vehicles – the dangers and risks can increase dramatically. In fact, the Texas Department of Public Safety explicitly warns truck drivers against the use of alcohol when driving commercial vehicles, as alcohol impairment can negatively impact driving in a number of ways, including: Slowed reaction time to… Read More

In many cases, these increased occurrences of accidents and injuries can be attributed to higher rates of impaired and intoxicated driving. In fact, the problem of DWIs and DUIs during this time of year have… Read More

Drunk Driving Accidents and Dram Shop Liability

A Corpus Christi family is making headlines with their recent lawsuit against an Austin bar – and shedding light on a little known liability law that holds drinking establishments accountable for over serving patrons. On July 1, 2012, the 25-year-old woman had been drinking with the young man at a local bar. After leaving together, the woman drove her vehicle down a boat… Read More

The Texas House passed a new law 130-0 which increases the penalties for drivers for who leave the scene of an accident. The legislation was passed in response to the tragic death of Courtney Griffin of Austin. Why You Need Gap Insurance

GAP (Guaranteed Asset Protection) insurance is one of those vehicle expenses that seem like a waste of money until you need it. In fact, unless you’ve already been in a collision that resulted in your car or truck being declared a total loss, you may not even know what GAP insurance is, or how important it can be. Imagine that you’re driving along a busy road, and another car swerves into your lane and hits you, causing severe damage to your car. Thankfully, you suffer only minor injuries, but you can’t say the same for your car. The insurance adjuster… Read More

Drunk Driving Crashes – Not “Accidents”

The Loewy Law Firm has been retained a family in Bastrop who was hit by a drunk driver who ran a red light. Our clients were heading to a Church event and were hit by a man who apparently had been drinking all day in a local bar. When the drunk driver was arrested, he was so intoxicated that he was laughing about the collision. Needless to say, drunk driving is no laughing matter and a person with this kind of disregard for fellow citizens should be in jail. Recent statistics have indicated that over 1400 Texans per year are killed by… Read More

DWI Accidents

The Loewy Law Firm has been retained to represent an Austin woman who was seriously injured in a collision caused by a drunk driver. Our client was at a red light on an outer road of IH-35 when a drunk driver careened over IH-35, drove down a grassy hill, and slammed directly into our client. Drunk driving accidents are some of the worst accidents our law firm handles. We are in complete agreement with Austin Police Chief Art Acevedo that drunk driving should not be tolerated in Austin and fully support ‘No Refusal’ weekends. Responsible citizens should always call for a cab… Read More

No Refusal Weekends – DWI Accidents

The Austin Police Department recently a conducted a “No Refusal Weekend” for Memorial Day. This is where if a police officer believes someone is intoxicated, the cop will not let the person “refuse” a blood test but, rather, will get a warrant from a Judge to draw the person’s blood. Many people think this is not constitutional but it actually is – in 1966, the Supreme Court held in Schmerber v. California that police could extract blood from a suspected drunk driver without the driver’s permission (as long as a Judge approved it). The Loewy Law Firm is a strong advocates for… Read More
